PRIVACY POLICY

Note: “ACS”, “we”, “us” or “our” in these documents refers to Alumni Consulting Services Inc. dba ACS Games and dba ACS Innovations

ACS respects the privacy of everyone who uses any of our apps. Please read this Privacy Policy and your End User License Agreement carefully so that you can understand how we collect and use the personal information that you provide to us.

By submitting your personal data to us, you will be treated as having given your permission for disclosures referred to in this policy.

What does this privacy policy cover?

This privacy policy covers our use of your personal information, game play stats and diagnostics (“Information”) which is collected through or in connection with our apps.

Who is responsible for the Information collected?

ACS controls the Information collected on this site. We operate on a paperless policy, using online technologies where Information is stored electronically, and securely on our computer systems.

Special Notice – if you are under 18 years old

If you are under 18 years old please do not send us your personal information (for example, your name, address and email address). If you are under 18 years old and you wish to ask a question or use this site in anyway which requires you to submit your personal information please get your parent or guardian to do so on your behalf.

Information collection and use

We collect and use Information (including name, address, telephone number and email) in order to:

  • respond to questions or requests submitted by you
  • process orders or applications submitted by you
  • administer or otherwise carry out our obligations in relation to any agreement you have with us
  • anticipate and resolve problems with services provided to you
  • improve and create products or services that may meet your needs.

As part of the services offered to you through our site, the information you provide to us may be transferred to countries outside of the European Economic Area (“EEA”). By way of example, this may happen if any of our servers are from time to time located in a country outside of the EEA or one of our service providers is located in a country outside of the EEA. These countries may not have similar data protection laws to the EEA. If we transfer your information outside of the EEA in this way, we will take steps to ensure that your privacy rights continue to be protected. In addition, if you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.

Except as set out in this privacy policy, we will not disclose any personally identifiable information without your permission unless we are legally entitled or required to do so (for example, if required to do so by legal process or for the purposes of prevention of fraud or other crime) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers etc.

Providing you with additional information and sharing your information

From time to time we would like to use your personal information for purposes other than as set out in the above section. We believe that these additional uses will be of benefit to you. However, we understand that you may not wish us to use your information in this way. We will not use your information for the purposes set out below if you have indicated that you do not wish us to use your information in this way when submitting the information. Additionally, if at any time you wish us to stop using your information for any or all of the below purposes, please let us know. We will stop the use of your information for such purposes as soon as it is reasonably possible to do so. In such case we will, however, continue to use your personal data for the purposes set out in the above section for as long as it is reasonable to do so.

From time to time we would like to use the information you supply to us for:

  • market research and tracking of sales data
  • informing you about our products and services, which may include contacting you by telephone

In addition, from time to time we would like to give your name, address and e-mail and any other personal data you supply to us to selected third parties, which may be located outside of the EEA. These third parties may use this information for:

  • market research and tracking of sales data
  • sending you information about their products and services
  • giving the information to their affiliate offices and companies to enable them to send you information which may be of interest to you.

Collection of non-personal information

We may automatically collect non-personal information about you such as the type of internet browsers you use or the web site from which you linked to our site. We may also aggregate details which you have submitted to the site (for example, your age and the town where you live). You cannot be identified from this information and it is only used to assist us in providing an effective service on this web site. We may from time to time supply third parties with this non-personal or aggregated data for uses in connection with this site.

The use of cookies

We may store some information (commonly known as a “cookie”) on your computer when you look at our site. We are able to read these cookies for information purposes when you revisit our web site. The type of information we collect as a result of a cookie being accepted by you is specific to your PC and includes the IP address, the date and time the PC visited the web site, what parts of our web site were looked at and whether the web pages requested were delivered successfully. This information is anonymous; it represents a computer rather than a person.

We use the cookie information to improve our knowledge of the use of our web site and to enable us to be able to ascertain whether the web site is operating at an optimal level. This allows us to enhance our web offerings to you and to provide an enjoyable and an innovative online experience.

You can erase or block this information by changing the settings on your computer (please refer to your help screens or manuals). If you do erase or block this information you may not be able to utilise some features of the site.

User anonymity and personal information
Log files are maintained and analyzed of all requests for files on ACS servers. Log files do not capture personal information but do capture the user’s IP address and username, which is automatically recognized by our servers.

Aggregated analysis of these log files is used to monitor app usage. These analyses may be made available to ACS staff and partner agencies to allow them to measure, for example, overall popularity of the site and typical user usage of our apps.

Except as stated already, ACS will make no attempt to identify individual users. You should be aware, however, that access to web pages will generally create log entries in the systems of your ISP or network service provider. These entities may be in a position to identify the client computer equipment used to access a page. Such monitoring would be done by the provider of network services and is beyond the responsibility or control of ACS.

In the case of all users, ACS reserves the right to attempt to identify and track any individual for legitimate purposes such as a) validating user’s game play or b) preventing or detecting unauthorised access to computer systems or resources operating as part of ACS.

All log file information collected by ACS is kept secure and no access to raw log files is given to any third party.

Use of cookies
Most websites you visit will use cookies in order to improve your user experience by enabling that website to ‘remember’ you, either for the duration of your visit (using a ‘session cookie’) or for repeat visits (using a ‘persistent cookie’).

Cookies do lots of different jobs, like letting you navigate between pages efficiently, storing your preferences, and generally improving your experience of a website. Cookies make the interaction between you and the website faster and easier. If a website doesn’t use cookies, it will think you are a new visitor every time you move to a new page on the site – for example, when you enter your login details and move to another page it won’t recognise you and it won’t be able to keep you logged in.

This website does not store any information that would, on its own, allow us to identify individual users of this service without their permission. Any cookies that may be used by this website are used either solely on a per session basis or to maintain user preferences. Cookies are not shared with any third parties.

Third Party Cookies and Embedded Content
We us Mail Chimp to handle our newsletter subscriptions and to display an archive or recent newsletters sent in our website. Mailchimp may use their own cookies so please check with www.mailchimp.com regarding their cookie usage and privacy policy.

Chat rooms, notice boards, newsgroups

If at any time an ACS app offers any chat rooms, notice board facilities, newsgroups etc we may collect the information that you disclose. Such information will be used in accordance with this privacy policy. Please note that we cannot be responsible for other parties’ use of the personal information which you make available to such third parties through any chat room, notice board, newsgroup etc on this site. Please be careful about what personal information you disclose in this way.

Email, (feedback) and forum facilities

If at any time an ACS app offers any e-mail, [feedback] or forum facilities, we may collect the information which you disclose. Such information will be used in accordance with this privacy policy. ACS maintains an electronic mailing list. Subscribers opt in to receive electronic newsletters about members, events and the online community. Personal data held for the electronic mailing list includes first and last names and email addresses.  There are also records on members’ open rates.

Keeping our records accurate

We aim to keep our information about you as accurate as possible. If you would like to review or change the details you have supplied us with, please contact us as set out below.

Security of your personal data

We have implemented technology and policies with the objective of protecting your privacy from unauthorised access and improper use and will update these measures as new technology becomes available, as appropriate.

Rights to your personal data

At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:

·  Right of access – you have the right to request a copy of the information that we hold about you.

·  Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.

·  Right to unsubscribe – you have the right to unsubscribe from mailings at any time, or to inactivate your membership. You may do this personally, by selecting the unsubscribe link on an electronic mailing, or by logging onto the online community. Alternatively, you may contact us to request that we remove you from an ACS mailing list.

Use of your personal information submitted to other web sites

We cannot be responsible for the privacy policies and practices of other web sites even if:

  • you accessed the third party web site using links from our web site; or
  • you linked to our web site from a third party web site.

We recommend that you check the policy of each site you visit and contact the owner or operator of such web site if you have any concerns or questions.

Submission of others personal information

From time to time ACS apps may ask you to provide personal details of your contacts, for example, so that we can send them details of our products and services. Before providing such information, please ensure that you have obtained their consent to their personal data being used in this way. We will not use these details in any manner which is incompatible with this privacy policy.

Will this privacy policy change?

From time to time we may make changes to this privacy policy. If we make any substantial changes to this privacy policy and the way in which we use your personal data we will post these changes on this page and will do our best to notify you of any significant changes. Please check our privacy policy on a regular basis.

Alumni Consulting Services Inc. (“ACS”) iOS Apps

End User License Agreement (“Agreement”)

Terms of Service: To use the ACS iOS Apps you must accept ACS’ Terms of Service listed here.

 

Parties: This Agreement is between you and ACS only, and not Apple, Inc. ACS, not Apple, is solely responsible for the ACS iOS Apps and their content.

 

Limited License: ACS grants you a limited, non-exclusive, non-transferable, revocable license to use the ACS iOS Apps for your personal, non-commercial purposes. You may only use the ACS iOS Apps on an iPhone, iPod Touch, iPad, or other Apple device that you own or control and as permitted by the Apple App Store Terms of Service.  You are not permitted to sell, transmit, host or otherwise commercially exploit ACS iOS Apps.  You are not permitted to copy or use ACS iOS Apps for any other purposes except for personal, non-commercial purposes.  You are not permitted to modify, decrypt, reverse compile or reverse engineer ACS iOS Apps.  You are not permitted to use ACS iOS Apps in any matter that would result in an unfair advantage over other users of ACS iOS Apps.  You are not permitted to use ACS iOS Apps in Canada if subscriptions are paid for outside of Canada (since purchases outside of Canada are not subject to GST).

 

Games and Services:  The Games and Services are comprised of works that are owned or licensed by ACS, and they are protected by copyright, trademark, trade dress, patent, and other worldwide intellectual property rights and other applicable laws, rules, or regulations. All such rights are reserved. These Terms do not grant you or any other party any right, title, or interest in the Services or any content in the Services.

 

Maintenance and Support: ACS does not guarantee any maintenance or support for our iOS Apps.  Maintenance and support are provided when available. To the extent that any maintenance or support is required by applicable law, ACS, not Apple, shall be obligated to furnish any such maintenance or support.

 

Feedback, Suggestions and Game Auditing: ACS accepts feedback and suggestions and stores game results for auditing and game improvement.  You agree that this is provided to ACS without any claim to compensation or credit.

 

Warranty: The ACS iOS Apps are provided on an “as is” basis. As such, ACS disclaims all warranties about the ACS iOS Apps to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, ACS, not Apple, shall be solely responsible for such warranty.

 

Product Claims: ACS does not make any warranties concerning the ACS iOS Apps. To the extent you have any claim arising from or related to your use of the ACS iOS apps, ACS not Apple is responsible for addressing any such claims which may include but are not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

 

Third Party Intellectual Property Claims: ACS shall not be obligated to indemnify or defend your with respect to any third party claim arising out of or relating to ACS iOS Apps. To the extent ACS is required to provide indemnification by applicable law, ACS, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the ACS iOS Apps or your use of it infringes any third party intellectual property right.

 

Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

 

Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using this Application. Your right to use this Application will terminate immediately if you violate any provision of this Agreement. The party providing your mobile OS has no obligation whatsoever to furnish any maintenance and support services with respect to this Application.

 

Third Party Beneficiary: Your mobile OS is a third party beneficiary of this Agreement, and, upon your acceptance, such third party beneficiary will have the right (and will be deemed to have accepted the right) to enforce this agreement against you.

 

Changes to This Agreement: ACS reserves the right, at its sole discretion, to modify or replace this Agreement at any time.  What constitutes a material change will be determined at the sole discretion of the Company.

 

Governing Law: This Agreement will be governed by and construed in accordance with and governed by the laws of the Province of Alberta, Canada.

 

Miscellaneous: This Agreement may only be modified in writing by authorized representatives of the parties. All notices required to authorized under this Agreement must be in writing and shall be send as applicable, to Alumni Consulting Services Inc., 301, 522 – 11TH AVENUE S.W. · Calgary, AB T2R 0C8 · Canada.  Waiver or terms of excuse or breach must be in writing and shall not constitute subsequent consent, waiver or excuse.
